If you defeat the Elite Four, Cobalion should be back in Mistralton Cave.
You can also obtain a Cobalion by Trade or an Action Replay Code.

I know how to cath him save your game before you v.s him and just turn it off if you don't cath him

One way to get him is to save right before you encontere him and if you kill him just turn of the DS and then get back on your game
