This is a special storyline which can only be acquired if you select a superstar who would be involved in the regular story at that point.

For example, the first RAW storyline, the one with Triple H, if you were to pick Triple H, Ric Flair or Shelton Benjamin as your character, then the legends storyline will replace it instead.

Same for Smackdown! Pick JBL, Orlando Jordan, or whoever else is involved, and you'll get the legends storyline.

The legends storyline can occur at anytime during the "story" mode, but will only happen once during a story, so, if you lose the legends battle royal in that storyline, then you're going to have to start story mode again.
