No, they cannot be used, due to the fact they are legendaries. As this, you also may not (I think) use Giratina. Something to do with the secrecy of the pokemon.

Don't listen to them, yes you can, I use my Arceus, Darkrai, and Giratina all the time on Wi-Fi and normal battles
It depends if they are legit. If they are, there's no problem, if they are hacked, they may not be able to use is some places, one of them, wi-fi connection. Hope this helps!
