You would only be able to get the garden shop by buying a bundle of smurfberries, if you are connected to the internet whenever you play, it would be the first thing that would pop-up on your screen, so yes, it is conditional for you to get the garden shop,
OR
If you are referring to the bug with papa smurf that he requires you to plant chili peppers or cauliflowers for you to progress into the game then the answer to that is update your game, there was an update a few days back, and that should fix the problem. Cheers!
