Yes, you need a way for you xbox to contact the gears of war web server, you at least need xbox live silver, and need to be connected.

Yes.
The photos go diorectly to the gearsofwar.com web server, so you need xbox live. You don't nee gold though,only silver.

Yes, you can't send it without being connected to Xbox Live.
