Do you have to be on line to use the phone, because every time I try to use the phone, it says I need to be sine into xbox live please someone help me.

No, you don't need to be online. But you can use the phone in the first 2 missions.

After the first 2 missions you can only play xbox live on your phone, but after that you can use it normaly

That is for multiplayer.
Once you are given a phone from roman, you can use it.

I don't believe the in-game phone and the internet have anything to do with one another. If it's asking you to sign into live, you're probably trying to activate a live-related cheat.
