CMBF answered:

The split screen orientation is part of the automatic video mode detection code in the game -- if you're playing the game in split screen and the game detects that your display is an SDTV, the game defaults to horizontal split screen and if it detects the display as HDTV it sets the mode to vertical -- there is no option to force it to go one way or the other it makes that decision on it's own.

The really strange thing though is that if the game detects the display as EDTV it seems to randomly set the mode, so one time you play it is vertical, and then another time, in the exact same area it decides to set it to horizontal. Strange eh?
