does it matter wot time of day you get the treasures cuz ive hav been told were the 6th treasure chest is but i can open it unless its not the 6th 1?

The treasures don't appear until you've gotten the previous one.
But time doesn't matter at all when it comes to the treasures. Are you trying to get the treasure whilst on a mission of some kind? Because that may be your problem. Also; check your location against some of the online guides to make sure your in the right place.
