I haven't had this problem, but there are other ways to get Regigas. First of all, there is an action replay code that will give you any Pokemon you want from the national dex. All you have to do is add the code specific to the Pokemon in the correct spot and then activate the code by pressing L and R in the game and then talk to the guy in the mining museum in Orebrough city. The museum is to the right of the Pokemon Center. He is at the counter, and he's the guy on the right. He'll give you the Pokemon for the code you activated when you talk to him. This code has been personaly tested by me so it should work.

Here is the neutral code for getting a Pokemon from the mining museum guy. It works for Pearl, and I don't konw if it works with diamond or platnum. NOTE: *** is where you input the pokemon's code

If you have these Pokemon in your party when you talk to the statue of Regigas in the snowpoint temple in snowpoint city, then you will battle him. (you still keep the regis in your party.

You can also just input the following code and get regigas from the mining museum guy, but you obviously don't get the other regis.
