Yes, there is a way.
After you get Kyogre in the Embedded Tower, save your game. Have a Pokemon that can make Kyogre get Paralyzed or Fall Asleep in your Party. After that, go into battle with Kyogre. Lower it's HP as low as you can, and then paralyze it or make it fall asleep. After that, start throwing Ultra Balls. It may take a while, but you can catch it.

Any form of Pokeball can be used to catch any wild pokemon. The Master Ball isn't required to catch anything. I haven't used a Master Ball since roughly 1998. The game is more fun when there is a challenge.

Yes get it's health down and get it either paralyzed or put it to sleep and then use lots of ultra balls.

Try using a regular Pokeball. I know somebody who keeps catching legendaries with regular pokeballs, and for whatever reason, after a while, it works. Try it yourself and see if it works. Hope this helps!
