I am in the Garden (Crow) have got all items many times and are left with just two to find and it says use a spirit spell but it will not let me use any spells. Have quit and restarted level many, many times and same thing happens every time.

You will need to use the brush to uncover one item, and the spirit sight for few more. The game doesn't restrict you from casting spells, it penalizes you if you don't do them correctly. If you lift the stylus from the screen and don't draw the it within the time limit, or don't follow the correct order, you will be returned to main screen. You can practice "casting spells" with the spellcast minigame.
